Guardianship

Guardianship moves legal decisions from one adult to another. A supported decision-making agreement keeps those rights with the person and names people who help them decide.

Status: Signed into law, effective July 1, 2024 · HB 73 · Last checked October 6, 2026

Last updated October 3, 2026

What this means for you

  • A 2024 law (HB 73) recognizes supported decision-making agreements in Florida and amended Fla. Stat. 393.12 and created Fla. Stat. 709.2209.
  • Courts must now consider a person's ability to make decisions with support before appointing a guardian advocate.
  • Guardianship can be plenary or limited, and guardian advocacy (Fla. Stat. 393.12) delegates only the specific rights the court finds the person lacks the ability to exercise.

Says guardianship should not automatically be the first or only option, and says families should have clear information about supported decision-making and other less restrictive alternatives.

"I believe the goal should always be to protect people while preserving as much independence, dignity, and personal choice as possible. Guardianship can be an important protection for individuals who truly need it, but it should not automatically be the first or only option because someone has a disability. Florida families should have clear information about supported decision-making and other less restrictive alternatives. Individuals should be supported in making their own decisions whenever they are capable of doing so, with appropriate safeguards when assistance is needed. Having advocated for children and families throughout my career, I understand that families want to protect their loved ones. They also want their loved ones to have the greatest possible opportunity for independence. We should make sure families understand their options and that decisions are based on the individual’s actual abilities and needs—not simply a diagnosis."
